My I-485 status is updated with the below message. LUD 05/21/2009. Surprisingly they mailed the document on 09 March 2009 and status update is on 05/21/2009

Current Status: Document mailed to applicant.
***On March 9, 2009*** we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
Previous LUD 03/31/2009 after completing FP in March 2009 with this message.
Current Status: This case has been sent to another office for processing because it has jurisdiction over the case.
Any clue, whats going on ?

I need help.My EAD has finally been approved and so has my I-140. I am now working for the petioning company but the pay checks are made out by a payroll company hired by petioning company to manage their staffs paychecks but their is no mention of the pertioning company on the paycheck I receive.. Can this be a problem if I should receive a RFE in the future for the still pending I-485 or eventually when I apply for citizenship?:confused:

I am in the same boat. Could someone answer this question ? I am trying to get affidavit from parents and the header reads "Affidavit of <wife's name> (known as <wife's previous name> at the time of birth". Is that good enough? BC has her pre-marriage name but it got issues just last week.

BC should always have wife's maiden name.. and affidavits can have wife's current name!!! That works out very well... thats how I got it for my wife.

Hi ,
I am working from home which is NJ on h1b and my company is based DC as my seat is located in DC and i connect remotely to my computer located in DC office , i have below question regarding the LCA and payroll
1. Which location i need to mentioned as primary ,home or where company located?
The LCA should list the job location as your home address.
2. Which state should the payroll runs where i live or where my seat is located?
It doesn't matter for immigration purposes.

Hello,
I was on valid 3-year H1 visa until Dec 2010. I got layed off in Feb 2009.
I found another employer to file my H1 transfer case in April '09 and the case is still pending (regular processing). We received a RFE asking for my most recent pay stubs and employer info recently.
The question I have is if the H1 transfer gets denied, what do I do next? How much time do I have to leave the US? Do they give time to pack and make plans to leave? I don't want to face deportation. Also, I have a valid 10- year B1/B2 visa stamped on my passport. Can I use that in any way.
Your response is greatly appreciated.

USCIS has recently published a new fact sheet of common questions and answers for members of the U.S. Armed Forces and their families. The fact sheet is worth reading if you are in the Armed Forces because the answers to some of the questions are different (and usually more advantageous) to members and/or dependents of those in the Armed Forces. For instance, if you are a civilian, obtained your green card through a marriage to a U.S. Citizen and you have been married for less than two years, you must file Form I-751, Petition to Remove Conditions on Residence (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=f858d59cb7a5d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD) to remove the conditional residence and obtain your permanent green card. Yes I declared my arrest in I485 and have got my EAD and AP aproved.
Did anyone in this situation travel on AP?

The only other thing I think should be stressed is that we are already H1-b holders, already applied for green cards, so not taking any more jobs away from USCs. All we are asking for is expedited processing of our already filed applications.
Then Numbersusa or other anti-immigration groups have no points to raise against us

I wonder when the USCIS will learn to stop playing games with our lives?
Here is my story…
I got my EAD card and AP document last month with a wrong date of birth printed on both documents due to USCIS error.
My Attorney contacted USCIS and he was advised to send the documents back for correction with no fees.
So, we refiled the application and attached the documents. Unfortunately, the entire package was returned to my Attorney requesting USCIS filing fees.
Now, we have filed a complaint with the USCIS Ombudsman’s office and requested their assistance in resolving this problem.
I am planning to use AC21 in Jan ’08, so I am desperately in need of EAD.
Has anyone ever been through similar situation? Do you know how long it will take to process a case at the Ombudsman’s office?
Also, if it is going to take another 2-3 months to get the corrected EAD, am I going to lose all those days or USCIS will print a new expiration date on my card?
Any comments or suggestions would be greatly appreciated.

I applied for H1 last year and got H1 approved for 9 months. (they counted all my stay on H4). Now H1 expired on 25th Nov and applied for H4 on 15th Nov before H1B expires.
I wants to take advantage of New memo of USCIS. Can I apply for H1B with different employer than earlier one while my H4 case is pending?
Or shall I wait until I gets H4 approval and they apply for H1B.
Please help me on this.

If yes, what's the option?

If they are staying on a resident or employment visa in UAE they have to apply at the US Embassy in Dubai. If they are on a visit visa in UAE, they have to apply at the appropriate US Consulate in India.

that shouldn't be any issue. She would be admitted at POE. However if she has filed for H4 extension and if the H4 extension is pending when she enters into US, the H4 extension will be considered abandonded and will be asked to go to consulate for stamping before her I-94 expires and can't use the approved H4 extension's I-94. check with yuour attorney on it.
