this is a little bit off topic, but does anyway know what are the requirements for practicing immigration law in the US? What kind of formal training and bar exam passing etc are needed?

With the extensive practice that USCIS has provided us, atleast in EB matters I think for most of us it will be a cakewalk. Having gone through the process ourselves we also understand how to treat the immigrant (frequent updates, clear answers, be accessible, provide all options and information) and some of us could make very good immi lawyers (once we get our EADs).

Guru's pl help..

One of friends 485(primary) was pending and his wife's 485(derivative) also pending.
Both of them are on H1(different employers) and they both lay-off around the same time about 4 months ago. My friends employer has been running paychecks for him but his wife's employer canceled her H1.

Is she now on "AOS" status or out-of-status?
Is she has to file H4 as my friend's dependent?

Sorry..I have incorrectly named the thread..it suppose to read this way- "Changed Employer (but not informed USCIS), travelling on AP" .
A couple of points : 485 is your property. Its a grey area whether to inform USCIS or not, some advocate it as its a proof and file AC21 and some have different opinion its a personal choice. Regarding using AP I myself dont see an issue. Rest of all are supporting dox. Nice to have supporting documents.

Informing USCIS is nothing but officially filing AC21. Since there are no forms its just a letter indicating AC21.

Hi,
Visa Interview: Que on Permission to enter New Delhi Embassy for 2 yr 3 months old Son

I am working in USA. I am planning to travel to India next month and require to apply for USA Visa interview.

I have 2 years and 3 months old younger Son who is born in USA and is a American Citizen holding American Passport.

Could you please shar exp. if he will be allowed to be with us during our Visa Interview in New Delhi Embassy. if Yes. pls let me know if there is any requirement for his entry inside the New Delhi Embassy.

They will allow you to carry your kids for the visa appointment. In fact you will get preferential treatment in the sense that you get a higher priority token fort he actual appointment and the VO maybe more sympathetic to your case. Iam quoting this from my own experience in late 2009 having my daughter who was 1 year and 3 months actually helped our cause we were out of the embassy in 30 minutes while there were people who waited for hours.

Hi All,
I am planning to paper file my wife's EAD renewal and AP for both me and my wife.
Questions:-
1. Can anyone who paper filed recently post information on filing EAD/AP
2. Since my wife filed for I-485 last year and paid $1010 fees,she falls under FEE WAIVER for both EAD and AP-I believe she can renew EAD/AP unlimited till she gets GC?
3. Can someone post what did they do additional for filing as FEE WAIVER?

Any detailed steps on paper filing with FEE WAIVER would be great.

mate no offense intended but if you do a search for this you will find all the info ready to be read for ya. So please take the time to do so. Some quick answers no you do not need to pay for EAD/AP renewal if you paid using the new fee structure. Also no additional info needed when you send a copy of your 485 receipt notice it states all the required info to support the no fees.

My Green card is in the processing and I-140 was approved in Dec 2007. The priority date is in Jun 2007 and EB2 category. Applied for renewal of EAD and AP recently.

I am on H1b and it is due for renewal in 3 months. I will be on H1b for 4 1/2 yrs by that time.
I hope h1b will be issued for 3 yrs since pending 485 for more than a year.
I think renewing is helpful just in case if there is any issue with 485.

1. Is it worth to renew H1b?
2. How much will it cost to renew H1b?
3. Since the h1b is issued for 3 yrs based on pending 485. If any issue with 485 will it impact H1b?

Thanks for taking time to answer my query. I have other problem so I am confused about this fact. My spouse's name is correct on passport. but her mother's surname has spelling mistake.All other details are correct. We were not aware of the fact till now. Now we are in the process of applying for I485.
So I am worried about all this. If I take affidavit, it will work?

Folks, can security check uncover unauthorized part time work whiles on H1. Will this be reported to USCIS? If so will that be a basis for denial for a green card? Any information or precedence?

It is legal to be paid for taking part in a clinical research study if you are on an H1B. The institution will provide you with a 1099 at the end of the year which you file with your tax return and of course declare the income.

In answer to the second posting not all research is experimental so the risks can be minimal if almost non existent and a very easy way to get a bit extra cash.

Applicants under 14 years of age: - Filing with the I-485 application of at least one parent have a fee total of $600 - Not filing with the I-485 application of at least one parent have a fee total of $930

I would assume that EAD and AP have to be paid for separately.
see the last paragraph. Looks like the new fee is a combined fee.
